This Web site allows you to share comments and suggestions regarding the eCommerce Modernization (eMod) Project. We want to hear what YOU want and need from the USPTO, as we plan to enhance the eCommerce experience and provide better customer service. For the entity size indication, when keeping the existing entity size at undiscounted, the resulting form states that it is a request to "change" to undiscounted status. To sharp-eyed clients, this looks like we filed in the incorrect status and are having to change it. Download Examiner-cited references to IDS

Currently, whenever the Examiner cites references, you have to manually hand-key them into an IDS form for submission in other cases. As the form we see in PAIR is obviously auto-generated, or at least all info contained therein is stored separately - see as proof the 'Download References' functionality - give us the option to download e.g. XML data for all references cited that can be imported directly into an IDS. ...more »

Allow different EFS filings to be opened in different tabs

Many attorneys work with staff members that help prepare documents and upload them to EFS for the attorney to review before filing. For IDS filings of complex families of cases, for example, this can mean having to review dozens of filings. Under the Domestic Benefit/National Stage Information section, since the first radio button labeled "Remove" does not work, could it be changed to "Add" instead (that works), so that when a Continuation, Divisional, or Continuation-in-part application is filed we can simply use the ADS from the parent application and choose the "Add" button to add our priority application? Inventor Order Changes in ADS

Currently, if you have a prepared ADS and the client requests to add an inventor to a location other than the end of the list or to change the order of the inventors, the current ADS form does not allow you to easily do that. Simplify Priority Claim in ADS (Combine Foreign and Domestic)

A recent idea was to combine the priority listings in PAIR into a single patent family showing foreign and domestic continuity, upstream and down, in a single location. Similarly, it would be convenient if practitioners could list a priority chain in an ADS that included domestic and foreign priority in a single location in the ADS (as compared to the present requirement that foreign and domestic priority be listed separately). ...more »

Provide proof copy of claims or patent before issuance

In order to help improve patent quality it would be helpful if the USPTO could provide a pre-publication or "proof" copy of the patent or the final claims before the patent issues and allow the applicant to check it via PAIR and submit corrections via EFS. Since this procedure might delay issuance (i.e. to allow time for response and corrections), it could be an optional opt. in procedure.

IDS Reference Date

The SB 08 A to be submitted to the PTO requested that the full month day and year be referenced next to each reference submitted. However when receiving references in an OA from the examiner, only the month and year are referenced. Very time consuming to have to look up each of those references just to find the day of the date to submit the SB 08 A.

Pre-exam policies and procedures should be public

Most of the internal pre-examination procedures are opaque outside of the USPTO. It would be very help to have, in writing, on the USPTO website the exact internal procedures used to evaluate whether a Power of Attorney form, drawings, application data sheet, etc. are compliant. This would help reduce errors and ultimately reduce USPTO staff work load.

Simplified Continuation Application Filing

A continuation or divisional application generally carries forward the original figures, specification, declaration, etc., as well as the IDS from its parent filing. It would be incredibly helpful if we could easily create a Continuation Application from a currently pending application, with auto-populated IDS, Spec, Figures, ADS. Drag and Drop Uploading of Files

Rather than loading one file at a time, it would save time to have a drag and drop interface for uploading files. This is fairly common in modern web interfaces, such as Wordpress, and easy to implement (CSS and Javascript) and there are canned solutions out there (for example, dropzone, filedrop, etc.). Don't Require Use of Proprietary PDF Programs

Stakeholders use a wide variety of PDF creation programs. eMod should be able to ingest a PDF created using a variety of programs. (e.g., don't require use of PDF creation by use of Vendor X's software) Either use a PDF specification that is open-source, or publish an SDK that could drive development by multiple vendors.

Batch Power of Attorney Filings

Currently, I can assign a number of cases simultaneously with a batch assignment, but I have to file a separate Power of Attorney in each case, via EFS. I use the same signed document for each (a general power of attorney). It would be much more efficient if we could add multiple matters to a single Power of Attorney filing.
