I think when you get the automatic approval of an e-Terminal Disclaimer in EFS, that the approval receipt document should include the patent/application number(s) that were listed in the disclaimer. I think it would also be very helpful if the notice on the front of the patent indicating that the patent is subject to a disclaimer also listed the patents/application number(s) disclaimed.
Allow us to save Assignment Templates at any stage of the Assignment process.
I have to go all the way to the end to save a template, which means it includes not only my data and the assignee data, but also the assignor data, which has to be edited (at a minimum the date the document was signed is unlikely to be the same.)
Allow us to save the template with just our data, as well as with our data & assignee data.
The rules specify at 37 CFR 1.55(f) the deadlines for filing a certified copy of the priority document. Failure to file a certified copy results in loss of priority benefits. Related rules specify requirements for a Petition to accept late filing of a certified copy of the priority document. There is no statutory requirement for a certified copy of the priority document. Currently the Petition for Foreign Filing License must be submitted via FAX. The petition and accompanying documents must be faxed to the appropriate office and, according to the people who process the petitions, the documents are not received in their mailbox until the following day. Practitioners and their assistants who used EFS, PAIR, Assignment recording, Maintenance fee payments, Fees, Forms, etc. frequently have to navigate clicking and scrolling through the PTO web site to get to the locations we need. Not Happy. The Office's decision to eliminate the ability to review Public PAIR data while logged into Private PAIR is a huge step in the wrong direction. What you are essentially asking users to do is to have two versions of PAIR open in order to do their daily duties. Please add the option to Disable a payment method from the Financial Center.
Right now the only way to remove a payment method is to delete it, which makes all past transaction records unavailable.
There should be an option to set a payment method to Inactive, either permanently or temporarily.
Although it is generally accepted that if you are filing a response to a Notice to File Missing Parts or Notice to File Corrected Application Papers via EFS that you do not need to submit a return copy, the Notice actually contains conflicting instructions (see attached screenshot). It would be convenient for citation purposes if the paragraph numbers in the published application match those in the specification as-filed. My suggestion is that, so long as the numbering in the as-filed specification meets the USPTO publication guidelines, the original paragraph numbering should be retained in the published specification. If EPAS pulled from the USPTO database and showed you the title associated with the patent/patent application number you have identified it would greatly reduce the number of mis-recorded assignments.
I have a few small clients that would prefer to handle maintenance fees on their own They would like to just change the fee address, but that is not possible without a customer number. So, the customer number should be much easier to get (online - instant - which it should be anyway) so I can easily handle that for them, or the PTO should permit post issuance communication address to be changed to an regular address... more »
POA rules and procedure could use an update so that practitioners can effectively remove their names and contact information from the record when no longer performing work for a patent owner. Currently, POA is required to change the Fee Address, and Correspondence Address for pre-AIA patents. These changes often occur after issuance.
