"Fee Address" Indication Form (SB/47) Submittal Via EFS

Enable Authorization of Deposit Account even if No fees are due

When you pay fees, you can authorize withdrawal of other fees from your deposit account.

 

This option is not available when no fees are being paid.

 

Please add the option. While we can & have used the response text to authorize the use of the deposit account, the Patent Office is not always consistent about noticing such an authorization.

Used Stored Credit Card Information like a Deposit Account

Now that the new Financial Manager stores credit card information, why not allow pre-authorized payment of fees from a stored credit card in the same way you pre-authorize payment (underpayment, extension fees, etc.) from a deposit account? Allow Setting up Patent Docket on My.USPTO.gov with Customer #

The Trademark Docket allows search by Attorney but the Patent Docket requires a listing of each application number for monitoring.

 

It would be very useful to be able to add to your Patent Docket by Customer Number. It is also logical, since you are logged into My.USPTO.gov and thus it is easy to provide the Customer Numbers associated with your log-in.

Cross-IDS Matters Automatically

We often file two or more related cases. One of the most frustrating parts of prosecution is having to keep up with cross-filing references between related applications.

 

But the Patent Office has both data sets available. It would be amazing if we could simply indicate that two cases are related enough for cross-referencing, without having to file the references, and sometimes office actions and responses.

Access Financial Manager via EFS login

After logging in to EFS using your PKI certificate, if you need to pay for something, you need to log in again to Financial Manager. This wastes time and often (for me at least) the link forwarding you to the financial manager page is broken, which means you cannot pay in the same session and causes a whole different set of problems. Corrections during filing of applications

Currently, if you discover that you have made a typo or checked a wrong box in the first part of a new application filing, there seems to be no way to go back and fix it without losing all of your uploads. You should be able to edit and fix these things easily at least prior to actual submission.

Recognize POA in Issued Patent to Allow for Withdrawal

POA rules and procedure could use an update so that practitioners can effectively remove their names and contact information from the record when no longer performing work for a patent owner. Currently, POA is required to change the Fee Address, and Correspondence Address for pre-AIA patents. These changes often occur after issuance. Pre-exam policies and procedures should be public

Most of the internal pre-examination procedures are opaque outside of the USPTO. It would be very help to have, in writing, on the USPTO website the exact internal procedures used to evaluate whether a Power of Attorney form, drawings, application data sheet, etc. are compliant. This would help reduce errors and ultimately reduce USPTO staff work load.

312 Amendment Workflow

When a 312 Amendment is submitted, could a workflow or message be sent to the Examiner to let them know. We often hear that 312 Amendments are not on the Examiner's docket yet, therefore, he can't act on them. Since we are running up against the Issue Fee due date, it would be great if we could get it on the Examiner's docket as soon as possible.
