Currently the form for the Notification to File Corrected Application Papers includes lots of check boxes but little room to enter free-form text. I have spoke to USPTO employees who have said (rightly or wrongly) that they are not permitted to provide free-form text and are instructed only to check boxes on the form. Often, the information conveyed in the checked box is so broad as to be useless and much time is spent... more »
Please add a quick link or button to access the next record in the Patent Maintenance Fees Storefront when you perform a bulk look-up. Currently the user has to use the breadcrumb link to return to the Lookup Results before selecting another item. It would be more efficient to simply move forward and backward to the next record. It would be additionally helpful to have the option to: 1) Jump to a specific record;... more »
Please add the option to Disable a payment method from the Financial Center.
Right now the only way to remove a payment method is to delete it, which makes all past transaction records unavailable.
There should be an option to set a payment method to Inactive, either permanently or temporarily.
ePAS currently does not allow for the recordation of title documents against both the PCT and National Phase records. Users are informed that the application has already been added if either the PCT number or US national number is entered and the user attempts to enter the other. We understand that the National Phase is not a new application, however, there exits separate records for both stages of examination. This... more »
Practitioners are often tasked with reviewing maintenance fee history. The data returned by the Office when looking up multiple records (max of 10 currently) is a great resource since it can be exported to Excel. Being able to upload data to make payments is helpful as well, however, it would be optimal to also be able to upload bulk data for the purpose of verifying past and future maintenance fee information. Helpful... more »
Although it is generally accepted that if you are filing a response to a Notice to File Missing Parts or Notice to File Corrected Application Papers via EFS that you do not need to submit a return copy, the Notice actually contains conflicting instructions (see attached screenshot). The standard language of the Notices should be updated to definitively state that if you are filing a response via EFS that no return copy... more »
The Trademark Docket allows search by Attorney but the Patent Docket requires a listing of each application number for monitoring.
It would be very useful to be able to add to your Patent Docket by Customer Number. It is also logical, since you are logged into My.USPTO.gov and thus it is easy to provide the Customer Numbers associated with your log-in.
While the US and other countries are moving toward transmission of these documents electronically, it would be nice to allow applicants to correct formalities in their priority claim that have been preventing the electronic retrieval of priority documents. Since there is a waiver in the rules for when the priority document must be supplied when it is available electronically, the Office should allow applicants to fix... more »
The rules specify at 37 CFR 1.55(f) the deadlines for filing a certified copy of the priority document. Failure to file a certified copy results in loss of priority benefits. Related rules specify requirements for a Petition to accept late filing of a certified copy of the priority document. There is no statutory requirement for a certified copy of the priority document. This is 2019!! Nobody, including patent examiners,... more »
I think the Maintenance Fee reminders and expiration notices should not be sent out on patents that are already expired due to their priority date, and that maintenance fees should not be shown as "due" on the fee payment page if the case is otherwise expired.
Update the description relating to patent expiration to include an "or" statement that a patent may have reached the end of the term. Example: Continuing application has an effective filing date of February 1, 1993 Patent issues on January 5, 2003 20 year term ends February 1, 2013 (providing there is no TD to shorten, or PTA to extend term) 11.5 year fee would be due July 5, 2014 The Patents Maintenance Fees Storefront... more »
POA rules and procedure could use an update so that practitioners can effectively remove their names and contact information from the record when no longer performing work for a patent owner. Currently, POA is required to change the Fee Address, and Correspondence Address for pre-AIA patents. These changes often occur after issuance. Furthermore, should a firm take over an issued patent and need to become the Fee Address... more »
The form (https://www.uspto.gov/patent/uspto-automated-interview-request-air-form) includes a mandatory phone number field formatted to accept 10 numeric digits. I am located overseas and do not find that this format accommodates a phone number in a foreign country. For one thing, there is no way to indicate that the first two or three digits are the country code. I believe this is usually indicated by preceding the... more »
If we log into the Financial Manager to pay Maintenance Fees, automatically provide a list of patents associated with our customer number(s) that have maintenance fees due.
This should reduce the number of inadvertently missed payments, and simplify the maintenance fee process.
The MyUSPTO links available on every USPTO web page should include a drop-down menu to either:
What Is It? (link to home page)
Having to click on the MyUSPTO link and then click on Sign In seems excessive when you know what you want. Even in the event that a user clicks on Sign In when they do not yet have an account, the sign in dialog box gives them the option to create one.
